1Scope

These Terms apply to every delivery person, delivery executive, rider, driver, logistics partner or other person authorised to perform deliveries through CTOC Foods ("Delivery Partner").

2Independent Responsibility

The Delivery Partner is responsible for complying with all applicable laws while operating a vehicle.

Nothing in these Terms authorises a Delivery Partner to violate traffic, motor vehicle, criminal, food-safety or other applicable laws.

3Valid Driving Licence

The Delivery Partner shall possess and maintain a valid driving licence appropriate for the vehicle being used.

The Delivery Partner shall not:

  • Drive without a valid licence
  • Allow another unauthorised person to use the account
  • Use an unauthorised vehicle where prohibited; or
  • Submit false documents.

4Helmet Requirement

When riding a motorcycle/scooter in a public place, the Delivery Partner must wear legally compliant protective headgear and comply with applicable Motor Vehicles Act requirements.

Section 129 of the Motor Vehicles Act requires protective headgear for persons riding motorcycles, subject to statutory exceptions.

5No Drunk or Drugged Driving

The Delivery Partner must never operate a vehicle while:

  • Under the influence of alcohol
  • Under the influence of drugs
  • Impaired by any intoxicating substance; or
  • Otherwise incapable of safely controlling the vehicle.

Section 185 of the Motor Vehicles Act addresses driving by a person under the influence of alcohol or drugs.

6Zero-Tolerance Safety Policy

CTOC Foods may suspend or terminate a Delivery Partner's account immediately where there is credible evidence of:

  • Drunk driving
  • Drugged driving
  • Dangerous driving
  • Repeated traffic violations
  • Helmet violations
  • Racing
  • Reckless riding
  • Harassment
  • Violence
  • Theft
  • Fraud; or
  • Serious safety violations.

7Delivery Partner's Personal Liability

The Delivery Partner is personally responsible for unlawful acts committed while operating a vehicle.

CTOC Foods/NexClass Technologies Private Limited does not authorise or encourage any violation of traffic or criminal law.

Where a Delivery Partner independently commits an offence, the Delivery Partner shall remain responsible to the extent provided by law.

8Vehicle Requirements

The Delivery Partner must ensure that the vehicle used for delivery is:

  • Legally registered
  • Properly maintained
  • Roadworthy
  • Covered by required insurance
  • Compliant with applicable permit requirements; and
  • Suitable for the intended delivery activity.

9Road Safety

The Delivery Partner shall:

  • Follow traffic signals
  • Follow speed limits
  • Avoid dangerous overtaking
  • Avoid mobile-phone use while riding where prohibited
  • Wear required safety equipment
  • Not carry unauthorised passengers where prohibited; and
  • Follow lawful directions of traffic authorities.

10Food Handling

The Delivery Partner shall handle food in a manner that avoids contamination or damage.

The Delivery Partner shall not:

  • Open food packages unnecessarily
  • Consume customer food
  • Tamper with orders
  • Mix incompatible goods
  • Deliberately expose food to contamination; or
  • Deliver food in an unsafe condition.

FSSAI has specifically emphasised training of last-mile delivery personnel in food safety and hygiene and preventing cross-contamination.

11Customer Conduct

Delivery Partners must behave professionally.

They shall not:

  • Threaten customers
  • Harass customers
  • Abuse customers
  • Enter private premises without permission
  • Demand unauthorised payment
  • Misuse customer information
  • Contact customers unnecessarily; or
  • Use customer information for personal purposes.

12Customer Privacy

Customer information obtained through CTOC Foods may be used only for legitimate delivery and platform purposes.

The Delivery Partner shall not copy, store, sell or share customer:

  • Phone numbers
  • Addresses
  • Names
  • Order details
  • Photos; or
  • Other personal information.

13Cash Collection

Where cash-on-delivery is enabled, the Delivery Partner must:

  • Collect the correct amount
  • Record the transaction accurately
  • Maintain collected funds securely; and
  • Deposit/settle funds according to the applicable procedure.

Fraudulent cash collection may result in account suspension, recovery and legal action.

14Accident

In case of an accident, the Delivery Partner shall take reasonable steps to protect life and safety and comply with applicable legal requirements.

The Delivery Partner must promptly report serious accidents to CTOC Foods.

15Documents

The Delivery Partner may be required to submit:

  • Identity proof
  • Driving licence
  • Vehicle registration
  • Insurance
  • Bank details
  • Photograph
  • Address information; and
  • Other legally necessary information.

16Platform Access

CTOC Foods may suspend access for:

  • Fraud
  • Safety violations
  • Document expiry
  • Customer harassment
  • Food tampering
  • Repeated complaints
  • Account sharing
  • Criminal activity
  • Dangerous driving; or
  • Material breach of these Terms.

17No Guarantee of Earnings

Unless separately agreed in writing, CTOC Foods does not guarantee:

  • A minimum number of orders
  • Minimum earnings
  • Working hours
  • Delivery volume; or
  • Continuous availability of delivery assignments.

18Taxes

The Delivery Partner is responsible for complying with applicable tax obligations arising from his/her income or business activities, subject to the actual legal relationship and applicable law.

19Indemnity

To the extent legally permissible, the Delivery Partner shall be responsible for losses caused by his/her unlawful conduct, fraud, intentional misconduct or violation of these Terms.

20Technology Provider

NexClass Technologies Private Limited provides technology infrastructure for CTOC Foods where applicable.

The technology provider does not authorise any Delivery Partner to violate law.

21Governing Law

These Terms shall be governed by Indian law and applicable state laws.

22Acceptance

By accepting delivery assignments through CTOC Foods, the Delivery Partner confirms that he/she has read and agreed to these Terms.
